The U.S. Court of Appeals for the D.C. Circuit ruled that President Obama violated the Constitution by naming these individuals to the Board. The NLRB must not ignore this ruling. No one, including the President, is above the Constitution. The court's decision is clear on this point: the President's end run around the Senate was unconstitutional. I am also concerned about the President naming Richard Corday as director of the Consumer Financial Protection Bureau (CFPB) under the same circumstances the court ruled invalid. Not only should these individuals step aside immediately but all of their actions should be voided. These agencies have been operating under a ruse for more than a year. Any decisions or regulations these invalid appointees have made are equally invalid. My legislation would force them to stop functioning as if they are valid and recognize the reality that this President overstepped his constitutional authority. Instead of continuing business as usual and issuing more rulings, the NLRB and CFPB should recognize that it is time to end this charade and honor the Constitution. Yesterday, on the Senate floor I called on the President’s unconstitutional appointees to the National Labor Relations Board (NLRB) to pack up the offices they have no right to occupy. The U.S. Court of Appeals for the D.C. Circuit ruled that President Obama violated the Constitution by naming these individuals to the Board.
